Terms & Conditions

Please ensure that you read and understand these terms and conditions before requesting your booking. If anything is unclear, please contact the Owner prior to making your booking, for clarification in order to avoid misunderstanding.

DEFINITIONS

When the following words are used in this Terms and Conditions document, this is what they mean:

  • Booking: your request to occupy the Property for the Rental Period as made via the Gloucester Stay website.
  • Booking Confirmation: the written confirmation sent by Us to You confirming the agreement for You to occupy the Property during the Rental Period.
  • We/Us/Gloucester Stay/The Owner/s: the owner of the Property.
  • Property: Flat 1, 39A Westgate Street, Gloucester.
  • Rental Period: the period of time for which the Property shall be available to the Guest as set out in the Booking Confirmation.
  • You/Your/The Guest/s: the guest and/or their invitees to the Property. The Lead Guest is the lead person on the Booking Confirmation.

When the words “writing” or “written” are used in these Terms, this will include email unless We state otherwise.

All bookings are subject to the following terms and conditions.

PAYMENT

  • We will send an invoice to You with the Booking Confirmation.
  • Payments must be made in full by bank transfer, and received by the Owner as cleared funds, by the date will be specified on the invoice in the Booking Confirmation. This date will be 7 days prior to Your arrival.
  • If the Rental Period is less than 7 days from the date of Booking, full payment will be required within 24hrs of receipt of the invoice and Booking Confirmation.
  • Any charges relating to the bank transfer are borne by the Guest.
  • Should the balance not be paid by You by the date specified, the Booking will be treated as a cancellation, with no refund of the deposit.

BOOKING CONDITIONS

  • The agreement to rent the Property (which incorporates these Terms) is entered into between You and The Owner once the Booking Confirmation has been issued.
  • You must be at least 18 years old when You make a booking for the Property and by making a Booking you confirm that you are at least 18 years old.
  • The number of persons occupying the Property must not exceed the number stated on the booking form. These persons must all be the same persons that are named on the booking form.
  • All Guests agree to arrive and leave the Property on the dates and times set out in the Booking Confirmation.
  • The Lead Guest will assume responsibility for all Guests’ compliance with the Terms and Conditions.
  • The Guest agrees that there will be No parties or events held at the property. A breach of this condition may result in a termination of occupancy without notice or refund.
  • Any activity undertaken which is illegal, or which may cause unreasonable noise, nuisance, damage or disturbance will lead to immediate termination of occupancy and forfeiture of all payments.
  • The Guest will keep the Property and all furniture, fixtures, fittings and effects in the Property in the same state of repair as at the commencement of the Rental Period, and shall leave the Property in the same state of cleanliness and general order in which it was found.
  • The Guest will not, under any circumstances, re-let or sublet the property, even free of charge.
  • The Guest understands and agrees that the Property is a No Smoking Property.

CHANGES TO BOOKING

  • You may request a change to the Booking by contacting Gloucester Stay by email – jeannie@gloucesterstay.co.uk
  • Any changes to the Booking are permitted at Our sole discretion, however We will always try our best to accommodate You.
  • Alterations to confirmed Bookings will be subject to any changes in price of the amended dates.

CANCELLATION POLICY

  • You may cancel free of charge up to 7 days before arrival and you will receive a full refund of all monies paid. Cancellation by You must be made in writing as soon as possible.
  • You will be charged the total price of the reservation if you cancel within 7 days before arrival.
  • We advise that you take out comprehensive travel insurance to cover cancellations. If You choose not to do so, then You accept responsibility for any loss that You may incur due to Your cancellation.
  • The Owner would only ever cancel the reservation due to the Property becoming unavailable for reasons beyond Our control, such as, but not a complete list:
    1. Fire, flood, electrics, water, or structural problems.
    2. Illegal activity which renders the Property a crime scene.
  • In these, or other circumstances, We would offer alternative dates to you, however if this is not possible for You, or unacceptable to You, the We will give a full refund of monies paid by You. Our liability would not extend beyond the refund.

DAMAGE TO PROPERTY

  • The Guest agrees to report any breakage or damage to the Owner immediately.
  • The Guest accepts full responsibility for any breakages, damage or theft caused by You, any member of Your party, or by any pet, to the Property or any item, fixture or fitting therein, and agrees to compensate the Owner in full, for any losses that may occur as a direct result.
  • The Owner is entitled to make demands for additional charges in the following circumstances:
    1. Should You leave the Property in an unacceptable condition (Our discretion) where extensive cleaning (in addition to regular cleaning) is required.
    2. Should We be required to remedy any damage caused to the Property, by You or Your party, during Your Rental Period.
  • In the event that You or any member of your party causes severe damage to the Property, which results in Us having to cancel subsequent bookings and/or pay compensation to any future guest due to the Property being left in an uninhabitable state by You, or which reduces the services offered to subsequent guests, You shall indemnify Us in full for any loss incurred by them.
  • The Guest acknowledges that there are to be No naked flames, such as lit candles, in the Property.

NO SMOKING

  • The Property, being Flat 1, 39a Westgate Street, and the entire building of 39a Westgate Street, including the stairways and entrance, is strictly a NO SMOKING Property.
  • This includes cigarettes, cigars, e-cigarettes, and vaping devices. Smoking or vaping is not permitted anywhere inside the Property.
  • A breach of this condition may result in immediate termination of occupancy and forfeiture of all payments received.

PET POLICY

  • No pets other than a dog is permitted in the Property.
  • One small/medium dog per stay, under 25kg, for a maximum of 3 nights.
  • The Property is on the first floor, and has no garden or outdoor space. The Guest accepts that large dogs, over 25kg, are not appropriate for this Property.
  • There is a charge of £20 per stay for the dog. However, if extra cleaning is needed above and beyond the regular amount, We have the right to charge a reasonable sum to cover the costs.
  • The Guest agrees to adhere to the following rules when bringing a dog into the Property:
    1. The Guest will bring a bed for the dog.
    2. The Guest will ensure that their dog is free from parasites and fleas before arriving at the Property.
    3. The dog must be under control at all times when in the Property
    4. The dog must NEVER be left unattended at the Property.
    5. The Guest is responsible for cleaning up after the dog both inside and outside the Property.
    6. The dog must be kept off the bed and the sofa. If this is not possible then the Guest must make sure that a suitable cover is on the bed or sofa prior to the dog being on it. Dog blankets can be provided by prior arrangement.
    7. On wet days the dog’s paws must be wiped dry before entering the Property.

NOISE

  • Out of respect to neighbours living in the building, we ask that all noise is kept to a minimum between the hours of 23.00 pm and 08.00 am.
  • The Guest must ensure that any deliveries or taxis are provided with clear instructions to the Property so as not to inconvenience neighbouring properties.

DURATION AND TIMES OF RENTAL

  • The Property will be available to You after 3 pm on the start date of the Rental Period. Earlier arrival may be possible but only by prior arrangement.
  • The Property must be vacated by 10 am on the last day of the Rental Period. It may be possible to leave the Property later, but only by prior arrangement.
  • Requests to arrive earlier or leave later than the time specified, must be put in writing to Us as soon as possible.
  • The Guest accepts that requests to arrive earlier or leave later than the specified time may not be possible and are solely at the discretion of the Owner.
  • Where a variation to arrival and departure times is requested by the Owner due to unforeseen circumstances, written notification to You will be provided.

ADVERTISING

  • We have compiled the information on Our website www.gloucesterstay.co.uk and any authorised third-party websites as accurately as possible; however, no warranties or representations (express or implied) are given in relation to the content on Our website.
  • The Guests accept that minor differences between text/photographs/illustrations on the website and the actual Property may arise. We cannot accept responsibility should the Property not conform to the Guests standards or any images on Our website.

RIGHTS OF ENTRY

  • The owner, or their representative, reserves the right to enter the Property at any time to undertake essential maintenance or for inspection purposes.
  • Should access be required, the Guest agrees not to obstruct the re-entry of the Owner (to include tradespeople) to the Property.

LOST PROPERTY

  • The Owner is not responsible for the loss of any personal property belonging to the Guest.
  • The Guest will contact the Owner as soon as possible after the stay if the Guest thinks that a personal item/s has been left at the Property.
  • The Owner will return your item by post, if requested, for a charge of £5 plus the postage fee. The total amount, which will be stated in writing by the Owner, must be paid by bank transfer, and cleared before the item is posted.
  • The Owner will not accept any responsibility for breakages or loss during the return process.
  • In the event of any personal property being found after Guest departure, We will contact the Lead Guest to inform them of what has been left, and will keep the item for 30 days, or until the Guest has requested the item to be returned to them, whichever is sooner.

COMPLAINTS AND COMPENSATION

  • Should the Guest wish to make a complaint about the Property, this must be done in writing during the Rental Period so that every attempt can be made by Us to resolve the issue as soon as possible during the stay.
  • In no circumstances will compensation be considered for complaints raised after the departure date, as this denies the Owner the opportunity of investigating the complaint during the Rental Period and endeavouring to remedy matters during the Rental Period.
  • No compensation will be paid for any temporary outage of electricity, water, TV service or internet connection.
  • The Owner will not be liable for any temporary defect or malfunction of equipment, machinery or appliance in the Property.

LIMITATION OF LIABILITY

  • Gloucester Stay does not exclude or limit its liability where it would be unlawful to do so. This includes liability for death or personal injury caused by Our negligence.
  • If We fail to comply with Our obligations under these Terms, We may be liable to You for any loss or damage You suffer that is foreseeable. Loss or damage is foreseeable if it is either obvious that it will happen, or if at the time of the Booking Confirmation both Us and You knew it might happen, for example, if You discussed it with Us during the booking process.
  • We are not responsible for any loss or damage that is not foreseeable.
